The process is simple. Once you decide you wish to pursue the avenue of mediation it is generally offered by one party with agreement then from the other party.
It is frowned upon by the judicial systems if a person declines the offer of mediation especially where costs are being covered by the other side.
Disputes that end up in court are often ordered to try mediation anyway!
